DMCA COPYRIGHT POLICY

Redfern Media respects the intellectual property rights of others and expects users of our websites, platforms, and services to do the same. This DMCA Copyright Policy applies to content that users or other third parties are permitted to submit, upload, post, transmit, or otherwise make available through a Redfern Media service.

1. Copyright Infringement Notices

If you believe that material made available through a Redfern Media service infringes a copyright that you own or are authorized to enforce, you may submit a written notification of claimed infringement to our Copyright Agent. To be effective under the Digital Millennium Copyright Act (“DMCA”), the notice should include substantially the following information:

  1. A physical or electronic signature of the copyright owner or a person authorized to act on the owner’s behalf.
  2. Identification of the copyrighted work claimed to have been infringed, or, if multiple copyrighted works are covered by a single notice, a representative list of those works.
  3. Identification of the material claimed to be infringing or to be the subject of infringing activity, together with information reasonably sufficient to allow Redfern Media to locate the material.
  4. Information reasonably sufficient to allow Redfern Media to contact you, such as your name, mailing address, telephone number, and email address.
  5. A statement that you have a good-faith belief that use of the material in the manner complained of is not authorized by the copyright owner, the copyright owner’s agent, or the law.
  6. A statement that the information in your notice is accurate and, under penalty of perjury, that you are the copyright owner or are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

3. Response to a Valid Notice

Upon receipt of a notice that substantially complies with the DMCA, Redfern Media may remove or disable access to the material identified in the notice. Where appropriate, we may notify the person who posted or provided the affected material and provide information regarding the notice and the opportunity to submit a counter-notification.

4. Counter-Notification

If you believe that material you submitted was removed or disabled as a result of mistake or misidentification, you may send a written counter-notification to the Copyright Agent identified above. A counter-notification should include substantially the following:

  1. Your physical or electronic signature.
  2. Identification of the material that was removed or to which access was disabled and the location at which the material appeared before it was removed or disabled.
  3. A statement, under penalty of perjury, that you have a good-faith belief that the material was removed or disabled as a result of mistake or misidentification of the material.
  4. Your name, address, and telephone number, together with a statement that you consent to the jurisdiction of the appropriate United States Federal District Court as provided by 17 U.S.C. § 512(g)(3), and that you will accept service of process from the person who submitted the original infringement notice or that person’s agent.

After receiving a valid counter-notification, Redfern Media may restore the affected material in accordance with the DMCA unless the original complaining party timely notifies us that it has filed an action seeking a court order to restrain the user from engaging in infringing activity relating to the material.

5. Repeat Infringers

In appropriate circumstances and at our discretion, Redfern Media may terminate or restrict the accounts or access of users who are determined to be repeat infringers. We may also remove or disable access to content when we have actual knowledge of infringement or when circumstances make infringing activity apparent, as permitted or required by applicable law.

6. Misrepresentations

Please consider carefully whether the material at issue is actually infringing before submitting a notice or counter-notification. The DMCA provides that a person who knowingly materially misrepresents that material or activity is infringing, or that material was removed or disabled by mistake or misidentification, may be liable for damages and other amounts permitted by law.

7. Other Copyright Questions

The DMCA process described above is intended for notices concerning copyright infringement involving material hosted, stored, or posted through a Redfern Media service. General copyright, trademark, privacy, or other legal inquiries should be directed to support@redfernmedia.com.

8. Changes to This Policy

Redfern Media may update this DMCA Copyright Policy from time to time. When we do, we will revise the “Last Updated” date shown above. The version posted on the applicable Redfern Media service will govern from the date it is posted.
